SPONSORS. The Giveaway prizes are sponsored by Brand 44 Colorado, Magellan, and Darryl Wattenberg ("Sponsors").

ELIGIBILITY. Void where prohibited by law. This giveaway is governed by U.S. law and is subject to all applicable federal, state, and local laws and regulations.

TIMING. The Giveaway begins at 9:00PM Eastern Daylight Time ("EDT") October 18, 2012 and ends at 11:59PM EDT November 28, 2012 ("Entry Period"). Entries submitted after November 28, 2012 are not eligible.

HOW TO ENTER. Giveaway participants must be 16 years of age or older. Giveaway participants must submit feedback to be used on the show. Audio submissions should be less than two (2) minutes in length including the giveaway participants' Geocaching.com screen name, your home location (i.e. Southern Indiana), and the comment or question. Do not include contact information in the audio of the submission. Audio may be submitted by calling the Cache-A-Maniacs voice mail line (206-350-3647, limited to 60 seconds per call) or in an AIF (44.1 or 48KHz), MP3 (minimum of 44.1KHz at 128kbps), or WAV (44.1 or 48KHz) audio file sent to the GeoGearHeads e-mail address (GeoGearHeads@CacheAManiacs.com) (file size limit of 4MB). Text entries may be sent by e-mail to the GeoGearHeads e-mail address (GeoGearHeads@CacheAManiacs.com) and must include the Geocaching.com screen name, your home location (i.e. Toronto, Canada), and the comment or question. All submissions by giveaway participants becomes the property of the Cache-A-Maniacs. Any audio deemed unusable whether due to poor audio quality or non-family friendly content will be discarded. Any submission of a non-family friendly nature will be discarded. Participants may submit more than one (1) feedback per Geocaching.com screen name but only one (1) submission per episode when it is used will be entered in the drawing.

PRIZES. One (1) prize, of a Magellan eXplorist GC to be awarded globally. One (1) prize of a Geomate Jr with Update Kit, one (1) Geomate Large Log Cache, and one (1) Geomate Gnome Cache to be awarded within the United States only. Additional prizes of not less than Five (5) will be contributed by Darryl Wattenberg. No substitution or transfer of prizes is permitted. All taxes and duties are the sole responsibility of the prize winners.

DRAWING. Winners will be selected by random drawing on November 29, 2012. The potential winners will be notified through the GeoGearHeads Podcast on Episode Beta.48 which will be recorded live on November 29, 2012 released December 1, 2012. Potential winners must contact the Cache-A-Maniacs by e-mail at GeoGearHeads@CacheAManiacs.com with mailing information and phone number to claim their prize. Return of any prize or prize notification as undeliverable, if Sponsors are unable to contact the potential winner after reasonable effort, or failure of potential winner to respond by December 15, 2012, will result in forfeiture of prize.

TERMS AND CONDITIONS. All sweepstakes entries become the property of the Sponsor. Sponsor shall be deemed sole interpreter of the rules and conditions. By participating, entrants acknowledge and agree to be bound by these rules and that the decisions of the Sponsor are final. BY ENTERING THE GIVEAWAY, ENTRANT AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, ITS PARENT, SUBSIDIARIES AND AFFILIATED COMPANIES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, CAUSES OF ACTION AND/OR LIABILITY FOR ANY INJURIES, ILLNESS OR DEATH, LOSS OR DAMAGE OF ANY KIND ARISING FROM OR IN CONNECTION WITH PARTICIPATION IN AND/OR ENTRY INTO THE GIVEAWAY OR RECEIPT OR POSSESSION, USE OR MISUSE OF ANY PRIZE OR ELEMENT THEREOF.

DISPUTES. This Giveaway is governed by the laws of the United States and the State of Michigan, without respect to conflict of law doctrines. As a condition of participating in this Giveaway, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Michigan having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
